TO: The Unknown Successor Personal Representative of the Estate of Mark S. Birge, AKA Mark S. Birge, Sr., AKA Mark Birge and The Unknown heirs, devisees, legatees, beneficiaries of Mark S. Birge II and their unknown creditors; and, the unknown executor, administrator, or personal representative of the Estate of Mark S. Birge II: BE IT KNOWN, that Nationstar Mortgage LLC d/b/a Mr. Cooper, the above-named Plaintiff, by its attorney, Elyssa M. Meade, has filed in the office of the Clerk of the Warrick Circuit Court its Complaint against Defendants The Unknown Successor Personal Representative of the Estate of Mark S. Birge, AKA Mark S. Birge, Sr., AKA Mark Birge and The Unknown heirs, devisees, legatees, beneficiaries of Mark S. Birge II and their unknown creditors; and, the unknown executor, administrator, or personal representative of the Estate of Mark S. Birge II, and the said Plaintiff having also filed in said Clerk’s office the affidavit of a competent person showing that the residence and whereabouts of the Defendants, The Unknown Successor Personal Representative of the Estate of Mark S. Birge, AKA Mark S. Birge, Sr., AKA Mark Birge and The Unknown heirs, devisees, legatees, beneficiaries of Mark S. Birge II and their unknown creditors; and, the unknown executor, administrator, or personal representative of the Estate of Mark S. Birge II, upon diligent inquiry are unknown, and that said cause of action is for default on the promissory note and to foreclose a mortgage on the following described real estate in Warrick County, State of Indiana, to wit: A part of the Northwest Quarter of the Southwest Quarter of Section Thirty-Six (36), Township Five (5) South, Range Eight (8) West of the Second Principal Meridian of Boon Civil Township, also being a part of Lot Nine (9) of Mac-Ray Acres Part Five as recorded in Plat File 1, Card 335 in the Office of the Recorder of Warrick County, Indiana, more particularly described as follows:

Commencing at the Southwest corner of said Lot Nine (9); thence North 0 Degrees 18 Minutes 52 Seconds West Forty-two and Fifty-one Hundredths (42.51) feet to the point of beginning; thence continuing North along said line Twenty-nine and Forty-three Hundredths (29.43) feet to the point of curvature of a non-tangent curve concave to the West, having a radius of Seventy (70) feet, a central angle of 9 Degrees 53 Minutes 42 Seconds and a chord of Twelve and Seven Hundredths (12.07) feet bearing North 5 Degrees 15 Minutes 47 Seconds West; thence North along said curve Twelve and Nine Hundredths (12.09) feet; thence North 66 Degrees 21 Minutes 23 Seconds East One Hundred Twenty-six and Thirty-six Hundredths (126.36) feet; thence South 0 Degrees 19 Minutes 00 Seconds East Ninety-Two and Forty-nine Hundredths (92.49) feet; thence North 89 Degrees 49 Minutes 19 Seconds West One Hundred Fifteen (115) feet to the point of beginning. commonly known as 1108 Chariton Drive, Boonville, IN 47601. NOW, THEREFORE, said Defendants are hereby notified of the filing and pendency of said Complaint against them and that unless they appear and answer or otherwise defend thereto within thirty (30) days after the last notice of this action is published, judgment by default may be entered against said Defendants for the relief demanded in the Complaint.
