ORDINANCE BY REZONING CERTAIN

REAL ESTATE IN

WARRICK COUNTY, INDIANA

BE IT ORDAINED BY THE COUNTY COMMISSIONERS OF WARRICK COUNTY, INDIANA:

Section I. That the Warrick County, Indiana Comprehensive Zoning Ordinance and the Warrick County Zoning District Maps dated February 1, 2005, and made a part of said Ordinance, be and the same are hereby amended as follows:

That the boundaries of the Agriculture District as shown on said Warrick County Zoning District Maps, be amended as to the following described real estate: Parcel #1 of the Euler Trust Property Parcelization, Part of the Southeast Quarter of Section 21, Township 6 South, Range 9 West of the 2nd P.M., lying in Ohio Township, Warrick County, Indiana and being more particularly described as follows:

Commencing at an 1" iron rod at the Southwest comer of said Quarter Section; thence along the South line of the Southwest Quarter of the Southeast Quarter said Section, North 89°39'12" East 572.53 feet to the Southeast comer of 35 acres off the West side of the Southeast Quarter of said Section; thence along the East line of said 35 acres, North 00°18'09" East 154.49 feet to a 5/8" rebar with LS cap inscribed "Donald Gries 29900003" at the true point of beginning; thence continue along said East line

1st: North 00°18'09" East 1135.18 feet to a 5/8" rebar with LS cap inscribed "Donald Gries 29900003" in the Southerly right of way line of Warrick Trail; thence along said right of way line for the following 3 (three) courses

2nd: South 89°35'06" East 145.26 feet a 5/8" rebar with LS cap inscribed "Donald Gries 29900003"; thence

3rd: along a curve to the right with an arc length of 226.47 feet, through a delta angle of 09°07'20", having a radius of 1422.42 feet and bearing a chord of South 85°01'26" East 226.23 feet a 5/8" rebar with LS cap inscribed "Donald Gries 29900003"; thence

4th: South 80°27'46" East 162.30 feet a 5/8" rebar with LS cap inscribed "Donald Gries 29900003" in the East line of the property conveyed to Julia L. Euler and Patricia J. Manino Co-Trustees of Trust No. 96 as described in deed recorded as Document Number 1997R-003678 in the office of the Recorder of Warrick County; thence along said East line

5th: South 00°16'18" West 1058.72 feet to a 5/8" rebar with LS cap inscribed "Easley S0006" in the North right of way line of State Road 66; thence along said right of way line for the following 3 (three) courses

6th: South 77°13'31" West 151.97 feet a 5/8" rebar with LS cap inscribed "Donald Gries 29900003"; thence

7th: South 89°40'49" West 328.30 feet a 5/8" rebar with LS cap inscribed "Donald Gries 29900003"; thence

8th: North 83°13'29" West 55 .55 feet to the true point of beginning and containing 13.681 acres more or less.

Subject To: The permanent extinguishment of all rights and easements of ingress and egress to, from, and across the limited access facility (known as S.R. 66 and as Project NH-006-5 (001), to and from the above described lands, along the 55 .55 foot (course eight) and 151.97 foot (course six) courses of the above described parcel. Also, along the West 141.08 feet and the East 134.70 feet of the 328.30 foot (course seven) course described above. This restriction shall be a covenant running with the land and shall be binding on all successors in title to the said abutting lands.

Also Subject To: A utility easement in favor of Indiana-American Water Company, Inc., as described in easement recorded as Document Number 2006R-013841 in the office of the Recorder of Warrick County, Indiana.

Also Subject To: A drainage and public utility easement, being 40 feet in width and lying Southerly of coincident with courses two through four of the above described parcel, said easement being recorded as Document Number 2015R-006050 in the office of the Recorder of Warrick County, Indiana.

which real estate is now zoned and classified as part of the Agriculture District, as shown on the aforesaid Warrick County Zoning District Maps, so that said above described real estate shall be and the same is hereby rezoned and reclassified from said Agriculture District to said General Commercial (C-4) District.

Section 2. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed.

Section 3. This Ordinance shall be in full force and effect from and after its passage by the Board of Commissioners of the County of Warrick, State of lndiana.
